Injunction on Trochanteric Fixation Nail (TFN) Revised
Solothurn/Switzerland, October 30, 2006
Synthes is pleased that on Friday, October 27 the Federal Court in Memphis, Tennessee issued a revised injunction order relating to Synthes’ TFN devices and a patent infringement case with Smith and Nephew. The order allows Synthes to continue selling its current TFN products, however, it can no longer sell or promote the use of the present TFN products to treat intertrochanteric fractures. In order to abide by the Court’s order, Synthes, during the next 30 day grace period, will be providing its customers with new instrumentation and technique guides to treat intertrochanteric fractures and all other prescribed indications for the TFN system. Nevertheless, Synthes intends to appeal this ruling.
Synthes is pleased that the Court revised its previous order and we thank our customers for their support and understanding.
